These Terms and Conditions (“Terms”) govern the use of the Mint Sorbet online store available at mint-sorbet.com (the “Website” or “Online Store”) and the purchase of products through the Online Store.

The Online Store is operated by Petra Berko, performing Personal Supplementary Work (Osebno dopolnilno delo – ODD) in the Republic of Slovenia under the trading name Mint Sorbet.

By using the Website and placing an order, you confirm that you have read and understood these Terms and agree to be bound by them.

These Terms apply to purchases made by consumers. They are governed by applicable Slovenian and European Union consumer protection legislation.

Mint Sorbet operates as a provider of handmade jewellery under the Slovenian Personal Supplementary Work (ODD) regime.


2. Products

Mint Sorbet offers handmade jewellery and related products through the Online Store.

Each product is handmade. As a result, minor variations in colour, texture, shape, finish or appearance may occur between individual pieces. Such variations are a natural characteristic of handmade products and do not constitute a defect where the product otherwise corresponds to its description.

Product photographs are intended to provide an accurate representation of the products. However, colours and appearance may vary slightly depending on the customer's device, screen settings, lighting conditions and other technical factors.

The relevant product page provides information about the product, including its materials, dimensions, colours and other relevant characteristics where applicable.

Mint Sorbet may update, modify or discontinue products offered through the Online Store at any time.


3. Product Safety and Care

Mint Sorbet takes product safety seriously and places products on the EU market in accordance with applicable product safety requirements.

Customers must use the products appropriately and follow any care or safety instructions provided with the product or on the relevant product page.

Jewellery should generally be protected from excessive exposure to water, perfumes, cosmetics, chemicals and other substances that may affect the materials or finish, unless otherwise stated for the particular product.

Customers should store jewellery appropriately and handle it with reasonable care.

Mint Sorbet is not responsible for damage caused by improper use, misuse, accidental damage, modifications, repairs performed by third parties, failure to follow care instructions or normal wear and tear, to the extent permitted by applicable law.

Nothing in this section limits the consumer's statutory rights concerning defective or non-conforming products.

Where required by applicable law, relevant product identification, safety and warning information will be provided on the product, packaging, accompanying documentation and/or the relevant product listing.


4. Prices

All prices displayed in the Online Store are stated in euros (EUR).

Mint Sorbet is not registered for VAT. Accordingly, VAT is not charged separately on the prices displayed, to the extent permitted by applicable Slovenian tax legislation.

Shipping costs are not included in the product price unless expressly stated otherwise.

The applicable shipping costs will be displayed during the checkout process before the customer places an order.

Mint Sorbet reserves the right to change product prices at any time. Price changes will not affect orders for which the purchase contract has already been concluded.

Discounts, promotional offers and discount codes may be offered from time to time. The conditions applicable to any such promotion will be stated at the time the promotion is offered.


5. Purchase Process

To purchase a product, the customer selects the desired product and adds it to the shopping cart.

The customer may review, change quantities or remove products from the shopping cart before proceeding to checkout.

During checkout, the customer provides the information necessary to process and deliver the order, including their name, e-mail address, billing information and delivery address.

The customer is responsible for ensuring that all information provided during checkout is accurate and complete.

Before submitting the order, the customer will be given an opportunity to review the main details of the order and correct any input errors.

By clicking the final order button indicating an obligation to pay, the customer submits a binding order.


6. Payment

The following payment methods are available through the Online Store:

  • Credit and debit card;

  • Apple Pay;

  • Google Pay;

  • PayPal.

The availability of individual payment methods may depend on the customer's device, location, payment provider and other technical circumstances.

Payment information may be processed by third-party payment service providers. Mint Sorbet does not have access to complete payment card details processed by such providers.

The customer will receive an order confirmation by e-mail after the order has been successfully submitted.


7. Conclusion of the Purchase Contract

The purchase contract is concluded between the customer and Petra Berko, operating under the trading name Mint Sorbet, when the customer receives an order confirmation by e-mail.

The order confirmation will contain the relevant information concerning the purchased products, prices, delivery costs and other important details of the order.

The version of these Terms applicable at the time the order was placed will apply to that purchase.

Mint Sorbet reserves the right to refuse or cancel an order in exceptional circumstances, including where a product is unavailable, there is an obvious technical or pricing error, or there are reasonable grounds to suspect fraudulent activity.

If an order is cancelled after payment has already been received, the amount paid for the cancelled order will be refunded.


8. Handmade and Personalised Products

Some products may be personalised or made according to the customer's specific instructions.

Where a product is clearly personalised or made according to the consumer's specific requirements, the statutory right of withdrawal may not apply where the applicable legal conditions for this exception are met.

The customer will be informed where an individual product is considered personalised for the purposes of the statutory withdrawal exception.

Personalisation does not affect the consumer's statutory rights concerning defective or non-conforming products.


9. Processing and Delivery

All products are handmade.

Orders are normally processed and prepared for dispatch within 1–3 business days after the purchase contract has been concluded and payment has been successfully received.

Orders are shipped using Pošta Slovenije.

The estimated delivery time after dispatch is normally 1–5 business days within the European Union.

Delivery times are estimates and may vary depending on the destination country and circumstances beyond Mint Sorbet's reasonable control, including postal delays, public holidays, weather conditions, customs procedures where applicable, strikes, technical problems or other unforeseen circumstances.

The customer will receive available shipping or tracking information where applicable.

Mint Sorbet currently ships orders only to destinations within the European Union.

The shipping cost is paid by the customer unless otherwise expressly stated during checkout.

The exact shipping cost applicable to an order will be displayed before the customer completes the purchase.


10. Delivery Problems

The customer is responsible for providing a correct and complete delivery address.

If an order cannot be delivered because the customer provided incorrect or incomplete delivery information, or because the customer fails to accept the shipment, Mint Sorbet may contact the customer to arrange further delivery.

Any additional delivery costs resulting from incorrect information or circumstances attributable to the customer may be charged to the customer to the extent permitted by applicable law.

This section does not affect any statutory consumer rights.


11. Right of Withdrawal

If you are a consumer, you generally have the right to withdraw from the purchase contract within 14 days without providing a reason.

For a contract concerning goods, the withdrawal period generally begins on the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods.

If multiple goods forming one order are delivered separately, the withdrawal period generally begins when the last good is received.

To exercise your right of withdrawal, you must notify Mint Sorbet of your decision before the expiry of the applicable 14-day withdrawal period.

You may use the applicable statutory model withdrawal form, but you are not required to do so.

After notifying Mint Sorbet of your withdrawal, you must return the goods without undue delay and no later than 14 days after notifying us of your decision to withdraw.


12. Return Costs

If you exercise your statutory 14-day right of withdrawal, you are responsible for the direct cost of returning the goods, unless applicable law provides otherwise.

The original standard delivery cost paid by the consumer will be reimbursed in accordance with applicable consumer protection legislation.

If the consumer selected a more expensive delivery method than the least expensive standard delivery option offered by Mint Sorbet, any additional delivery cost will not be reimbursed.

The consumer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.


13. Refunds

Following a valid withdrawal, Mint Sorbet will reimburse the payments received from the consumer in accordance with applicable law.

The refund will generally include the cost of the least expensive standard delivery option offered by Mint Sorbet.

Mint Sorbet may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, whichever occurs first, where permitted by applicable law.

Refunds will normally be made using the same payment method used for the original transaction, unless otherwise agreed with the consumer.


14. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply to goods made according to the consumer's specific instructions or clearly personalised for the consumer, where the applicable legal conditions for the exception are fulfilled.

For example, a jewellery item individually personalised according to the customer's specific requirements may not be eligible for withdrawal.

This exception does not apply to defects or lack of conformity and does not limit any other mandatory statutory consumer rights.


15. Defective, Damaged or Non-Conforming Products

Mint Sorbet is responsible for ensuring that products supplied to consumers conform to the purchase contract and applicable legal requirements.

If a product arrives damaged, is defective, is materially different from the product ordered, or otherwise does not conform to the contract, the customer should contact Mint Sorbet as soon as reasonably possible at:

The customer should provide the order number and, where appropriate, photographs or other information showing the problem.

If the product is defective, damaged upon delivery or otherwise fails to conform to the purchase contract, Mint Sorbet will cover the necessary return costs and provide the remedy required under applicable consumer protection legislation.

Depending on the circumstances and applicable law, the consumer may be entitled to repair, replacement, an appropriate price reduction or termination of the contract and reimbursement.

Nothing in these Terms limits or excludes the consumer's mandatory statutory rights.


16. Normal Wear and Tear

Handmade jewellery may naturally change in appearance through normal use.

Examples may include scratches, surface wear, tarnishing, discolouration or other changes caused by ordinary use or exposure to substances such as water, perfume, cosmetics or chemicals.

Such changes do not necessarily constitute a defect.

This section does not affect the consumer's statutory rights where a product was already defective or non-conforming at the time of delivery.

Customers may submit complaints, questions or claims relating to an order by contacting:

To help us process a complaint efficiently, customers should provide their order number and a description of the issue.

Mint Sorbet will handle complaints in accordance with applicable Slovenian and EU consumer protection legislation.

We will make reasonable efforts to resolve complaints promptly and amicably.


18. Product Safety and Recalls

Mint Sorbet complies with applicable EU product safety requirements.

If Mint Sorbet becomes aware that a product placed on the market presents a safety risk, we will take appropriate measures in accordance with applicable legislation, which may include contacting affected customers, providing safety instructions, withdrawing products from sale or conducting a product recall.

Customers are encouraged to contact Mint Sorbet promptly if they become aware of a safety issue relating to a product.


19. Intellectual Property

All content available on the Website, including photographs, product photographs, graphics, logos, brand elements, text, designs and other materials, is owned by or licensed to Mint Sorbet unless otherwise stated.

The content may not be copied, reproduced, modified, distributed or used for commercial purposes without prior written permission, except where permitted by applicable law.


20. Website Use

Customers agree to use the Website only for lawful purposes.

Customers must not attempt to interfere with the operation or security of the Website, gain unauthorised access to its systems, introduce malicious software or otherwise use the Website in a manner that may cause damage to Mint Sorbet or third parties.

Mint Sorbet may temporarily suspend or modify access to the Website where necessary for maintenance, security, technical reasons or other legitimate purposes.


21. Personal Data

Personal data collected through the Website is processed in accordance with applicable data protection legislation, including the General Data Protection Regulation (EU) 2016/679 (GDPR) and applicable Slovenian legislation.

Information regarding the processing of personal data is provided in the Mint Sorbet Privacy Policy.


22. Third-Party Services

The Website uses third-party services necessary for its operation, including Shopify, payment providers and shipping services.

Third-party providers may process personal data and other information to the extent necessary to provide their services.

The use of such services is also subject to the applicable terms and privacy policies of the respective providers.


23. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Mint Sorbet is not responsible for losses resulting from circumstances beyond its reasonable control, including postal delays, technical failures, natural disasters, strikes or other unforeseeable events, except where mandatory law provides otherwise.

Mint Sorbet is not responsible for damage resulting from improper use of products, failure to follow applicable care instructions, accidental damage or unauthorised modifications, to the extent permitted by law.

Nothing in these Terms limits or excludes any mandatory consumer rights.


24. Governing Law

These Terms and the purchase contracts concluded through the Online Store are governed by the laws of the Republic of Slovenia.

Where the customer is a consumer residing in another EU Member State, this choice of law does not deprive the consumer of the protection provided by mandatory consumer protection provisions applicable in their country of residence.


25. Alternative Dispute Resolution

Mint Sorbet will make reasonable efforts to resolve any consumer complaint directly and amicably.

Consumers may have the right to use an authorised alternative dispute resolution (ADR) procedure in accordance with applicable Slovenian legislation.

Information concerning applicable ADR procedures and competent bodies will be provided to consumers where required by law.


26. Changes to These Terms

Mint Sorbet may update these Terms from time to time to reflect changes in the Website, products, business operations or applicable legislation.

The version of the Terms applicable at the time an order is placed will govern that purchase, unless a change is required by law to apply differently.
